Apple Begins Sending Out 'Batterygate' Settlement Payments

Apple has started sending out 'batterygate' settlement payments to iPhone users that joined a class action lawsuit against the company over its throttling of various iPhone models. The deadline to submit a claim form was October 6, 2020.
The consolidated class action lawsuit dates back to 2017 when Plaintiffs alleged that a performance management feature introduced for iPhone 6, 6 Plus, 6s, 6s Plus, and SE devices in iOS 10.2.1, and introduced for iPhone 7 and 7 Plus devices in iOS 11.2, diminished the performance of some of those devices. In 2020, Apple agreed to pay up to $500 million to settle the case, but refused to acknowledge any wrongdoing.
Last month, the website for the 'Smartphone Performance Settlement' announced that Apple exhausted its last remaining appeal and would begin distributing payments to users in January.

The United States Court of Appeals for the Ninth Circuit has dismissed the last remaining appeal in the In re Apple Inc. Device Performance Litigation, and the Effective Date of the Settlement, as described in the Settlement Agreement, occurred on November 6, 2023. The exact distribution date is not known at this time. Based on the timeline set forth in the Settlement Agreement, we anticipate distribution should occur sometime in January 2024.
