Apple Requests Complete Damages Retrial of Samsung Patent Case and a Permanent Injunction

Following the recent trial versus Samsung in which Apple was awarded $119.6 million in damages, Apple is now requesting additional liability findings, a tripling of the largest part of the damages award, a permanent injunction, and a complete damages retrial, reports Foss Patents.

Late Friday, Apple filed a motion for a U.S. permanent injunction against Samsung with respect to the three patents Samsung was found infringing on. The injunction would constitute a U.S. sales ban of the devices addressed at trial and any "software or code capable of implementing any Infringing Feature, and/or any feature not more than colorably different therefrom."

In addition to the injunction request, Apple is asking Judge Koh for a complete damages retrial.


PLEASE TAKE NOTICE that on July 10, 2014, at 1:30 p.m., or as soon thereafter as the matter may be heard by the Honorable Lucy H. Koh in Courtroom 8, United States District Court for the Northern District of California, Robert F. Peckham Federal Building, 280 South 1st Street, San Jose, CA 95113, Plaintiff Apple Inc. (“Apple”) shall and hereby does move for judgment as a matter of law (renewed), an amended judgment, a new trial, and damages enhancements against Samsung Electronics Co., Ltd., Samsung Electronics America, Inc., and Samsung Telecommunications America, Inc. (“Samsung”)

It doesn't seem likely that Judge Koh would grant a damages retrial; however, she could make some minor adjustments to the verdict.
