EU to Charge Apple With Violating Digital Markets Act [Report]

Posted June 14, 2024 at 8:15pm by iClarified
The European Union will likely charge Apple with failing to adhere to its new Digital Markets Act before the summer, according to a new report from Reuters.

EU regulators will issue preliminary findings which are similar to antitrust charges before the summer break in August, with Apple the first to be charged, followed by Meta, the sources said.
The Commission and Meta declined to comment. Apple referred to its March statement where it said that it was confident that its plan complies with the DMA and that it continues to constructively engage with the Commission.

In March, the EU opened a non-compliance investigation into Apple, suspecting that the company has failed to meet its obligations under the new Digital Markets Act. It is examining whether Apple allows app developers to "steer" consumers to offers outside the gatekeepers' app stores, whether the company's new fee structure and other terms and conditions for alternative app stores and distribution of apps from the web (sideloading) may be defeating the purpose of its obligations, and whether Apple is in compliance with user choice obligations.

It's believed that the EU intends to charge Apple based on its anti-steering rules, which hinder developers from informing users about offers outside the App Store, and also its new fees levied on app developers. The investigation on user choice obligations is expected to take more time.
