Apple Could Get More Than $1 Billion in Damages From Samsung With New Trial

While Judge Koh reduced the damages awarded to Apple in the company's first jury verdict, a new trial for those products could result in a potentially greater award, notes FOSS Patents.

Apple will still be able to demand far more than $450 million with respect to the 14 "vacated damages" products. If the new jury doesn't reevaluate liability, or if it does but arrives at a result materially consistent with the first jury's findings, and if the new jury adopts Apple's damages claims as the right number or alternatively decides to adopt a higher pecentage (than the first jury's 40%), then the total damages award could be substantially greater.

Samsung confirmed the possibility itself in a late-Friday filing, saying that "Apple can seek even more damages on these products in the new trial".


The second damages trial covers the Galaxy Prevail, Gem, Indulge, Infuse 4G, Galaxy SII AT&T, Captivate, Continuum, Droid Charge, Epic 4G, Exhibit 4G, Galaxy Tab, Nexus S 4G, Replenish, and Transform.

So what?!? The righteousness of Apple's claims against Samsung do not have anything to do with whether they innovate or not. Of course the iPhone was an amalgamation of existing technologies, wrapped together in a novel way to create a new product. I personally disagree with the whole patent system, the way you can patent an f'ing rectangle or just an unbuildable idea you drew up on a cocktail napkin. But that's not the point! The point is that THROUGH THE SYSTEM Samsung was found to have copied Apple. And therefore Apple is right in protecting its intellectual property and ensuring that its millions of dollars invested in R&D (which is NOT the same as innovation, but still essential) are protected from pirates. End of discussion, if we're staying on track and sticking to reason rather than rantings.

After reading more background on this issue, it is so muddied, how can anyone in the general populous cast judgement on either side? I'll wait for the courts on this one. BTW, I bought a Samsung because it does exactly and I mean exactly what I want for a lot less money. I don't need all the bells and whistles that the iPad has. I also have a Galaxy Ace II and same thing. It does all I want very well without the exorbitant cost of an iPhone.

A rational comment. Good job. Agree completely with the concept of buying the product that fits your needs. Personally, I love my iPad. But that doesn't make it better than your Ace. To each his (or her) own.

Justabrake...you are 1000% on the ball. This litigation stuff is bullshit. When is the last time we saw an 'innovative' product from Apple? And I mean new, not a reiteration? All they are making themselves look like is desperate and scared. Don't show them in court, show them with new things we would want to buy from Apple! THAT'S how to win!
