Five Big Issues to Be Decided at Major Apple vs. Samsung Hearing Today

Christopher Carani, a partner at McAndrews, Held & Malloy, notes that five big issues will be decided at a major hearing today for Apple vs. Samsung.

Fortune reports on what those issues are:

1. Liability: Will Judge Koh set aside any of the jury's findings on liability?
2. Juror Misconduct: Will Judge Koh set aside the verdict and grant a new trial based upon alleged juror misconduct?
3. Injunction: Will Judge Koh enter a permanent injunction, prohibiting the sales of the 24 Samsung telephones in the U.S.
4. Enhanced Damages: Will Judge Koh increase the amount of damages based on the jurors' findings of willful infringement?
5. Supplemental Damages and Interest: Will Judge Koh tack on more $$ for supplemental damages (i.e. infringing sales since jury's finding) and prejudgment and post-judgment interest.

Regarding the picture: The Samsung has bigger curves, is bigger in general, has more buttons below the screen, has a front facing camera, has a different colour bezel, is running a completely different operating system, has a different shaped home button, has a larger earpiece. A Bridge-stone tyre has more in common with a Michelin tyre than these 2 phones.

Let see how would you feel if you have spent millions of US$ in research and development of a product... put it out to the market and another company would come in spend a few hundreds making a few mods on your project and call it theirs...

I think you'll find they spent a lot more than a few hundred. The internal hardware is completely different. I'm not defending Samsung, I'm just stating facts. Samsung wouldn't come to defend me in any-way, neither would Apple, so I have no loyalties to either. I'm just fed up of patent wars that are detrimental to progress.

@GarethPN ---- You're right about the "loyalties" part and I wish everybody was thinking the same way too. On the other hand, the initial Galaxy phones and tablet hardware and UI designs were shamelessly ripped off from the corresponding Apple devices. So the whole story begun at a point where Apple was more than right when it accused Samsung. Besides, I've always believed that behind all these Apple-strikes against Android-device manufacturers, is underlying Job's wrath against Google's initial iOS rip-off (of course, now, both iOS and Android are two different stories, with Windows Phone OS being the most 'original' rival).

I am impressed with what I have seen of windows phone so far, my wife has one. After having a play about with it, I prefer it to my iPhone and think it will be my next upgrade.
