Apple has lost an appeal to a U.K. High Court's judgement that Samsung did not infringe their iPad design and that the company must run ads stating as much, reports Reuters.
Britain's Court of Appeal agreed with the High Court ruling that despite similarities, Samsung's Galaxy tablet did not infringe Apple's iPad design, in part because they were "not as cool".
In addition to the decision which is said to be valid throughout Europe, Apple is being forced to run ads stating that Samsung did not copy its registered tablet designs on its website and in newspapers.
Samsung happily said, "We continue to believe that Apple was not the first to design a tablet with a rectangular shape and rounded corners".
Apple can still appeal to the Supreme Court but it's unclear if it will.
