Court Grants Sony's Temporary Restraining Order Against Geohot

The United States District Court of California has granted Sony's request for a Temporary Restraining Order and Order of Impoundment against Geohot over the PS3 jailbreak.

Having considered all the papers and arguments, the Court finds that SCEA has shown a likelihood of success on the merits of its claims for violation of the DMCA and CFAA, and that it will suffer irreparable harm unless Defeendant Hotz's violations are enjoined. The Court also finds that a Temporary Restraining Order and Order of Impoundment are necessary to prevent immediate and irreparable injury to SCEA before the hearing on the Order to Show Cause regarding the preliminary injunction can take place, and to preserve the status quo. The Court further finds that the balance of equity and interests of justice support granting such relief.

The Electronic Frontier Foundation recently addressed the matter. "That [Sony] can silence speech that reveals security flaws using the DMCA and that the mere fact of a terms of use somewhere gives a company permanent and total control over what you do with a device under pain of criminal punishment — are both sweeping and frightening". Its more than a little concerning that the United States Court is upholding Sony's actions.

Well, sony wants their customers to be stupid, without education, knowledges, so they can't harm their hardware. If you match this profile, go buy sony. There are so many other brands with better products, even cheaper, why to buy sony's shit?

Well, i think Sony are putting their guns on the head. Definetely, the percentage of the sony product would go down. first instance. i was planning to get one. now, i won't get because no jailbreak no life. support jb people it's should be freedom becuase it's mine if i buy and whatever i would like to do it's mine freedom. Hope Sony loses this. I need my damn iphone to be unlocked. and yes i agree with the first post. I bought the damn machine. It belongs to me! I can do what ever the hell i wish to it, like trash it, cut it up rip it apart... and mod it if i wanted.

He should send all his info to wikileaks, then let a lot more underground hackers to let rip and break the ps3 down just as they did with the iphone and psp! Would you buy a car from ford then let them tell you you cant respray it, change the engine or modify the wheels or even modify the cars software to gain performance, NO BLOODY WAY!!! so why let them dictate what we can and cannot do with anything we buy.. if thats the case, they should not ask for a lump sum up front, yet they should rent it to us for a small fee per month, then the item belongs to them hence being able to tell us what we can/cannot do with it!!

This argument has no merit. Car vs PS3??? pppffft. Of course you can modify your car to no other benfit than making it faster or making it look nicer. You can't get anything for free if you modify a car. If you circumvent the security on your PS3, what else are you going to do? Install Linux? I highly doubt it.

That's like saying why do cassette recorders, vhs recorders, dvd recorders etc have record features when it is illegal to record even from the radio, yet even sony themselves sell such products. theyre frightened that ppl will download their games and play them for free! yet on the other hand, if pay £50+ for gran turismo and my todler scratches it, even if i have the original disc and case and even the receipt, sony will not give you a refund or exchange, but if i could make a backup of such media, then episodes described above would be of no issue!

I totally agree with you. Whatever we buy is ours and we can modify it as we please, Now the software companies are trying to say buy my stuff but you can't modify it because it still belongs to the software company? That's giving them too much power.
