The United States Court of Appeals for the District of Columbia Circuit has upheld legislation that requires ByteDance divest itself of TikTok by January 19, 2025.
A three judge panel unanimously ruled to deny to ByteDance's challenge to the Protecting Americans from Foreign Adversary Controlled Applications Act.
-----
JUDGEMENT
These causes came to be heard on the petitions for review of constitutionality of the Protecting Americans from Foreign Adversary Controlled Applications Act and were argued by counsel. On consideration thereof, it is
ORDERED and ADJUDGED that the petitions for review be denied, in accordance with the opinion of the court filed herein this date.
-----
The "Protecting Americans from Foreign Adversary Controlled Applications Act", is a section of H.R. 8038 that aims to block any foreign adversary controlled application, not just TikTok. It was passed by the House on April 20, 2024 and by the Senate on April 23, 2024. President Joe Biden signed the act into law on April 24, 2024.
If ByteDance does not divest itself of TikTok, U.S. based app stores and Internet infrastructure providers would be prohibited from helping TikTok continue operations. It's very possible that we'll see an appeal to the Supreme Court; however, it seems unlikely that the law would be blocked on an emergency basis.
