The iPhone 4G Leak Investigation has come to a bit of a pause while the District Attorney reevaluates the validity of their warrant to raid Gizmodo.
According to TechCrunch who spoke to Stephen Wagstaffe, Chief Deputy at San Mateo County District Attorney’s Office, nobody has been charged in the case and at this point it is “just an investigation”.
He says the investigation is “looking at any hand that touched or had something to do with this phone” but that the investigation is not currently targeting either Gawker or the person who originally found the phone — rather, police are collecting every fact they can to present to the DA, who will then make a decision.
Wagstaffe said that the prosecutor felt that the shield protection laws did not apply so they executed the raid. However, Gawker's lawyers have presented some reasons why they believe Jason Chen should be protected so the investigation has come to a bit of a pause while the DA reevaluates whether those shield laws do apply.
The DA says they will not begin going through Chen's possessions until they have reached that decision and admitted to TechCrunch that is unusual to evaluate the shield protection laws after having already removed the evidence.
