Apple is still including EarPods in the box with every iPhone 12 sold in France despite removing EarPods and Power Adapters from the box elsewhere.
The company is doing so to comply with French law.
According to Law No. 2015-136:
at the request of the purchaser of a mobile phone, the operator must provide an accessory such as a hands-free kit or headset suitable for children under 14 years of age.
Promoting the use of a mobile phone by children without the use of an accessory that limits electromagnetic waves is punishable by a criminal fine.
promoting the use of a mobile phone without this accessory is punishable by a criminal fine of 75,000 euros (375,000 euros for a legal person), as is the absence of affixing of the health warning
Unfortunately, users elsewhere in the world will need to buy their own EarPods or Apple Charger. AirPods Pro are currently on sale for $199 and Anker's Nano charger provides 20W in a compact adapter.
