Apple CEO Tim Cook to Be Deposed June 27 in Apple vs. Qualcomm Case

Apple CEO Tim Cook is scheduled to be deposed on June 27th in the Apple vs. Qualcomm lawsuit, reports Bloomberg reporter Mark Gurman.

Back in January 2017, Apple sued Qualcomm for allegedly withholding $1 billion in rebates because it complied with Korean regulators investigating Qualcomm. It has since expanded that lawsuit on the heels of a recent Supreme Court ruling, arguing that the license agreements that give Qualcomm a cut of every iPhone manufactured are invalid. Apple requested that its contract manufacturers withhold royalties to Qualcomm until the dispute is resolved. Qualcomm then sued Hon Hai, Pegatron, Wistron, and Compal.

In June 2017, a federal judge ruled that an FTC antitrust lawsuit against Qualcomm can proceed. In July, Qualcomm filed a complaint with the United States International Trade Commission alleging that Apple has infringed on six Qualcomm patents that 'enabled important features and functions in iPhones'. That same month, Apple's contract manufacturers joined its countersuit against Qualcomm saying the lawsuit against them is "yet another chapter of Qualcomm’s anticompetitive scheme to dominate modem chip markets, extract supracompetitive royalties, and break its commitments to license its cellular technology on fair, reasonable and non-discriminatory terms."

Last October, Qualcomm was fined a record $773 million by Taiwan's Fair Trade Commission for antitrust violations. A few days later the company filed a lawsuit seeking to ban iPhone sales and manufacturing in China.

In November, Qualcomm filed another lawsuit against Apple accusing the company of breaching the terms of its software license and using its unprecedented access to that code to help Intel.

Qualcomm Incorporated (“Qualcomm”), Apple Inc. (“Apple”) and Compal Electronics, Inc., FIH Mobile Ltd., Hon Hai Precision Industry Co., Ltd., Pegatron Corporation and Wistron Corpora
tion (collectively, “the CMs”), by and through their respective counsel, hereby jointly move for an order approving the following stipulation:

STIPULATION
WHEREAS, Mr. Tim Cook is the Chief Executive Officer of Plaintiff Apple;
WHEREAS, Qualcomm requested the deposition of Mr. Cook in the above-captioned action (the “Action”);
WHEREAS, Qualcomm and Apple attempted to schedule Mr. Cook’s deposition on a date prior to May 11, 2018, the close of fact discovery in the Action;
WHEREAS, Qualcomm and Apple were unable to find a mutually convenient deposition date during that period when Mr. Cook, Apple, and Qualcomm are all available;
WHEREAS, the Parties to this Action have agreed to conduct Mr. Cook’s deposition on June 27, 2018;
WHEREAS, the Parties agree that conducting Mr. Cook’s deposition on June 27, 2018 will not otherwise affect any deadlines ordered by the Court in this Action.
NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned counsel:
The deposition of Mr. Tim Cook shall be conducted on June 27, 2018.
