Amazon has won a dismissal of Apple's lawsuit against the company for alleged false advertising over its use of the term 'app store', Bloomberg reports.
Amazon.com Inc. (AMZN) won dismissal of a claim by Apple Inc. (AAPL) of false advertising in its trademark lawsuit over the use of the term “app store,” according to a ruling today in San Francisco federal court.
In a complaint filed March 18, 2012, Apple had accused Amazon.com of trademark infringement and unfair competition and asked for a court order to prevent the company from using the "App Store" name.
"Amazon has begun improperly using Apple's App Store mark in connection with Amazon's mobile software developer program," Apple said in the complaint.
