Amazon is asking a federal judge to throw out Apple's false advertising claims in a lawsuit over use of the 'app store' term, reports Reuters.
In a complaint filed March 18, Apple accused Amazon.com of trademark infringement and unfair competition and asked for a court order to prevent the company from using the "App Store" name.
"Amazon has begun improperly using Apple's App Store mark in connection with Amazon's mobile software developer program," Apple said in the complaint. Amazon also plans to use the name with a mobile software download service
Microsoft and Amazon have both been fighting Apple's attempted registration of the App Store term. Amazon notes that even Apple Chief Executive Tim Cook and his predecessor Steve Jobs have used the term generically, with Cook having commented on "the number of app stores out there" and Jobs referring to the "four app stores on Android."
