Apple considers the iPhone 4G prototype being showcased around the web to be stolen property, not a lost device, according to Daring Fireball.
The new owner of the device said it was found on the floor of a San Jose bar inside an iPhone 3G case; however, this information can't really be confirmed.
In Gizmodo's hands-on report they note that Gruber said the device was reported lost and Apple wants it back. That isn't technically correct as Gruber makes clear...
Note that I did not use the word lost. It is my understanding that Apple considers this unit stolen, not lost. And as for the someone(s) who found it, I believe it is disingenuous for Gizmodo to play coy, as though they dont know who the someones are.

Of course it was stolen.. That's always Apple's approach these days. Sue, threaten, bully and obstruct.

Don't worry fanboy-- I didn't say you weren't extra cool with ur new iPad in your hand (only that you'd be cooler once you know what to do with it). ;)

Well Apple, its a little late now. The secret is out and all over the web. Maybe you should of reported it stolen about 20 minutes after it being lost. Ever think of that?

Could be worse. Imagine it being put on craigslist and they had to buy it back. Lol.
