A U.S. jury has found Samsung guilty of copying the iPhone and determined the company must pay Apple $1,051,855,000 in damages.
The Verge breaks down some of the damages: - Prevail: $57,000,000 - Infused 4G: $44,792,974 - Transform: $954,060 - Replenish: $3,350,256 - Mesmerize: $53,123,612
The jury also found that all Apple's patents were valid and Samsung willfully infringed on them in many cases. Notably, they determined the iPhone's trade dress (visual appearance) is protectable but only on the iPhone 3G.
The registered iPhone and unregistered iPhone were diluted, but only those. The Fascinate, Galaxy S, Galaxy S 4G, Showcase, Mesmerize, and Vibrant are all found to have diluted the trade dress.
Ruling on Samsung's case against Apple, the jury found that Apple did not violate any of Samsung's patents and awarded Samsung $0 in damages. However, the jury also found that Samsung did not breach its obligations when developing the UTMS standard and that they did not violate the antitrust act.
Finally, the jury decided that Samsung patents '516 and '941 are barred by patent exhaustion from being enforced against Apple.
While Apple did not win all the decisions it was looking for, this can only be described as a huge win for the company.
Ya the parts are manufactured by Samsung but they were designed and engineered by Apple. And they're assembled in china not Korea. Second of all if apple wanted to find another manufacture for their parts and components they could easily do so. They already have been slowly moving away from Samsung's displays for LGs and sharps. But the thing is no matter what the outcome of these lawsuits are Samsung would never drop apple as a customer. The profits they make from their business is too high to lose. If apple would even consider leaving them for another manufacture Samsung would be on their knees begging them to stay.
hey guys i have something to talk about here. Great Apple won, but remember how BILL GATES also did the same thing to Steve jobs with creating WINDOWS without telling APPLE and copied their idea. Clearly Samsung thought that if Bill dint get into any trouble, we wont face any troubles either. Well hats of to APPLE for winning the case and striking Freaking SAMSUNG COPY CATS.
go APPLE :) :) U ROCK the technology industry :)
Jus wondering what did apple actually came up with that wasn't already there? Don't get me wrong I am all apple and buy all their product... But I do wonder sometimes what they came up with on their own...
If apple wanted to they could easily switch to another manufacture or supplier that's just as good. They've Already gradually started moving away from Samsung's displays and stated using LG and Sharp. Even though its not hardware its Just like what they're doing with google. They're lowering their dependency from competitors and creating business relationships with new companies. Apple doing this is gonna take billions away from both google and Samsung's profits. Its said google makes 2-3 billion a year from iOS. They make more money from the licensing for iOS than they do from android. Googles just shit outta luck at this point but unless Apple themselves starts finding other suppliers for components I don't see Samsung dropping them as a customer just because of this lawsuit. It's a big part of their business and profits. Even though "Samsung" as a whole is a company they operate under different divisions. Displays, components, chips, appliances, computers, etc. They'd loose 10s of billions of dollars if they did something stupid like that.
Damn - i was just about to set up an company that main business-model would have been just picking fantastic products and copying them.
DAMN DAMN DAMN. Now sue Ikea next!
Victory! So there is justice after all! Now ban all Samsungs copycat products and lets them invent something of their own - that i call win for the consumers too. Technology doesn't advance by copying but by innovations - inventing something that others doesn't already have.
At the end of the day like all cases it all boiled down to what which party could prove on the day. It doesn't really matter what your opinions are about who came up with what design/idea.
It doesn't really matter what we think about who stole what from the other. At the end of the day Apple was able to present evidence which on the balance of probabilities convinced a jury Samsung copied from them. Case closed...we should all move on. I'm sure both companies are.
Congrats to Apple for winning this paten trial and an advise to all if you have an idea get it right in the paten system this way no one will said is theirs and you will get an easy trial in court. people protect your ideas like apple does.
