AT&T has announced that it will not throttle customers on unlimited plans until they pass 3GB in data usage, according to a statement on their site.
Do you have an unlimited data plan? If so, we have information to help you manage your account if you use more than 3GB, which means you are in the top 5% of data users in our network. If you have a 4G LTE Smartphone with monthly data usage over 5GB, you'll also be interested in this information. You can check your usage for this month by dialing *data# on your mobile phone.
The company has received a lot of negative publicity over the throttling of unlimited customers who surpassed 2GB of data. One AT&T customer was awarded $850 in the matter after taking AT&T to court.
While 3GB of data is of course better than 2GB, throttling unlimited customers down to nearly unusable speeds hardly qualifies as unlimited.
Their point is, if you're an employ. And your make 10 dls an hour, like others. you don't want to works more then them or double then them. Because you know you don't get more for what you do, you always going to try to work as they do. Because. It wont be fair for you is you over do it. Even if you sign a application. where you right that you are going to do better then other. Same here, they said. Alot of people. Don't use more then 2 gigs a month, when other use more then 20 gigs, I will love to have my Internet unlimited like before but. For now Is impossible. I love to be able to tether my iPad. Without paying more. But is not possible. If you can sued them do so.or send a complain to BBB, like I did.it will help,
Hopefully this isn't for everyone, because I haven't received a email for throttling and I have been going over 2 gigs. Sorry but I don't want to be on the same team as the other people getting throttled. Not to say I wasn't pissed that AT&T was doing this to others it just wasn't happening to me. I'm sure it's all about location.
Look like my complain to the BBB! Works. A least we have one more gig,and the fight is not over, we have to get what we pay for, without abusing the network data usage. Pls people. Watch movies or video when are on WI-FI. We have to be fair.so we don't have this kind of situations.
A few days ago, I filed a complaint with FCC and will be filing with Better Business Bureau. If you choose to file a FCC complaint, select the "informal complaint option". I used parts of this verbiage from this post in another forum when I filed my FCC complaint:

This is really great information and I strongly urge anyone throttled to file both complains and file a small claims suit against AT&T. It is not as difficult as you might think. In most states, it doesn't cost much (NJ is $37) and you can (and most do) proceed without an attorney. AT&T can be sued in any state they do business in (which is all 50 states I believe) and they cannot use motions or any other legal-ese in order to get out of the case. Basically you get a court date within 30 days or so and simply bring your contract and email/text from AT&T about throttling and argue that your plan is not unlimited.
If enough people win a couple hundred bucks, it might make AT&T go look up the word unlimited in the dictionary...
So they are going to tell us to our faces your contract is unlimited data but now we can't and won't give you full speed after 3 GBs and even if it wasn't mentioned in the contract you signed up for
they haven't throttled me ! but I hate to have these threats of it hanging over my head and thinking each month are they going to send me that message.
