An International Trade Commission judge has ruled that Samsung infringes on four of six patents alleged by Apple, reports AllThingsD.
In his initial determination, ITC Judge Thomas Pender found that Samsung’s products violate Apple’s ’949, ’922, ’678, and ’501 patents. The first refers to touchscreen heuristics and lists Steve Jobs as an inventor; the second describes a “method and apparatus for providing translucent images on a computer display”; the third, elements of the iPhone’s design; and the last, “audio I/O headset plug and plug detection circuitry.”
The ruling has still to be approved by the full six-member commission.
There's actually a lot more to this story. If you care to research and find out then go to the ITC government website and you will find that Samsung is being investigated in a series of other "shady" patent dealings. It's not just an Apple vs. Samsung thing anymore; its not USA vs. the world. To read a one paragraph summation posted on a blog online and think that one is prepared to provide opinions on the matter is flawed. Go inform yourselves.
Also, most of the patents in question deal with the way in which certain processes on the iPhone work, not how the phone looks. Any company who spends billions of dollars researching and creating new ways for non-standardized processes have every right to defend their property. If Samsung wishes to use those then Samsung should (like everyone else) license those patents or create their own method. To say that innovation is hindered because Apple continues to sue the competition is silly. If anything, it is creating an environment that forces other companies to create different (hopefully better) ways in which our devices perform tasks--that's innovation.
